Thank you for your interest in the LUNA Trial from Luna Imaging, Inc.

By using our Services, you are agreeing to the terms listed below. Please read them carefully.

Using Our Services

You must follow any policies within the Services made available to you.

Don’t abuse our Services. For example, don’t try to access or interfere with our Services using a method other than the instructions and interface we provide. We may stop providing our Services to you if you don’t comply with our terms or policies or if we suspect misconduct.

You do not have ownership of any intellectual property rights in our Services.

You may not use logos or branding from our Services without our permission.

Any legal notices displayed in or along with our Services must remain untouched.

Our Services display content that does not belong to Luna Imaging, Inc. This content is the sole responsibility of those who have uploaded it to the Services. We are not obligated to review the content, however, we may remove content if it violates our policies.

In connection with our Services and the LUNA Trial we may send you service announcements and other information. You may opt out of those communications.

Your LUNA Accounts

We will assign username and password combinations to you and your organization. These accounts will be unique to you. Please do not share them with anyone else.

Privacy and Copyright Protection

We do not collect any information we get from your use of the Services. And we do not collect any personal information.

Your Content in our Services

Your use of our Services allows you to upload content to our servers. All content you upload belongs to you and stays yours. Upon completion of the LUNA Trial all content you uploaded will be deleted. You may request to have your content migrated to a dedicated LUNA instance should you become a regular client of Luna Imaging, Inc. There could be a migration fee for this service.

You are solely responsible for your content. Make sure you have the necessary rights and licenses, consents, permissions, waivers and releases to use and display your content.

Make sure your content is not designed for use in any illegal activity or to promote illegal activities, including, without limitation, use in a manner that might be libelous or defamatory or otherwise malicious, illegal or harmful to any person or entity, or discriminatory based on race, sex, religion, nationality, disability, sexual orientation, or age.

You may upload up to 30GB to our Services. If you need more please let us know.

About Software in our Services

You may not, and may not attempt to, modify, alter, tamper with, repair, or otherwise create derivative works of our software.

You may not, and may not attempt to, reverse engineer, disassemble, or decompile the software or the Services or apply any other process or procedure to derive the source code of any software we provide.

Modifying and Terminating our Services

You can stop using our Services at any time. The LUNA Trial is available to you as long as you need to use it, but we will be in touch with you frequently to ensure you’re getting the most out of the Service. If for any reason we decide to end this free trial service, we will notify you in advance.

We can remove your access to the Service at any time if we feel you are abusing the Service.

Luna provides our Services using a commercially reasonable level of skill and care and we hope that you will enjoy using them. But there are certain things that we don’t promise about our Services.

Our Warranties and Disclaimers

OTHER THAN AS EXPRESSLY SET OUT IN THSE TERMS OR ADDITIONAL TERMS, LUNA DOES NOT MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICES, THE SPECIFIC FUNCTION OF THE SERVICES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SERVICES “AS IS”.

SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHNTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRNTIES.

Liability for our Services

WHEN PERMITTED BY LAW, LUNA, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF LUNA, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIM UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES.

IN ALL CASES, LUNA, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE.

About these Terms

We may modify these terms at any time. Changes will not apply retroactively. However, any change for legal reasons or changes addressing new functions of the Service will be effective immediately. If you do not agree to the changes in the terms you should discontinue your use of our Service.

If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future).
